Just three months after enrolling her children, Breann Barnard arrived for a routine pickup and was met with screams. Staff offered no clear explanation. Multiple versions of the story were given — Bella hit a filing cabinet, or maybe a chair. But Bella said something different: “Mr. Bernard did it.”

Video Footage Reveals the Moment of Injury and the Cover-Up
Months after the incident, after hiring legal counsel, Barnard finally obtained footage from the daycare. The video, which captures the moments leading up to and following the injury, raises serious questions about staff conduct and safety protocols.
In the video, Bella is seen playing at the front desk area with other children and staff nearby. Another child falls from a rolling chair and lies on the floor for nearly a minute while no one intervenes. Moments later, staff member Bernard Randle enters the area and tells Bella, “Come on, let’s go. We gotta go. You can’t stay up here.”
As Randle attempts to guide her away, Bella begins to scream and immediately clutches her arm. Another employee, identified as Sequoia Benson-Scofield, intervenes, insisting, “Nothing happened to her arm,” and offering to “vouch” for Randle. Bella continues to cry and insists, “Mr. Bernard did it.”
Rather than provide medical care or call emergency services, staff members are seen dismissing her cries, suggesting she was being “overdramatic,” and even implying she was faking the pain. They repeatedly touch her arm and ask leading questions in an apparent attempt to alter her account of what happened.
Fifteen minutes after the injury, Bella was given an ice pack. No accident report was filed. No call was made to her mother.
“It appears she’s being tortured,” said attorney Al Lasso. “Usually, as a child, you expect adults to help you and comfort you. It was just the opposite in this case.”
Dislocated Elbow Diagnosed at ER with Evidence of Significant Force
When Barnard finally arrived, the staff still gave no clear account. She took her daughter straight to the emergency room, where doctors diagnosed a dislocated elbow. Medical staff told her that it would have required “significant force” to cause that kind of injury in a child.
“Someone had to really aggressively do something for a child's elbow to come out the way that it did,” Barnard said.
The lawsuit filed by Lasso Injury Law accuses the daycare of negligence, assault and battery, failure to report the injury, and attempting to cover up what happened.
Repeated Staffing Issues and a History of Complaints
The Magic of Learning has faced previous regulatory complaints. According to records from Nevada’s childcare licensing bureau, eight complaints were filed against the daycare in 2024 and 2025. The only substantiated issues involved “being out of ratio,” meaning there were too few staff members supervising too many children.
Bella’s injury was never documented by the daycare. It did not appear in official records, and no report was filed with the state.
State officials confirmed the incident was not reported and that a new investigation is now underway. Henderson police also have an open case.
This isn’t the first time the daycare has been accused of mishandling children. Just one month before Bella’s injury, a complaint alleged that a staff member picked up a child “by the hands and wrists.” That complaint was not substantiated, but taken with the current lawsuit, it suggests a pattern of questionable handling practices and failure to protect vulnerable children.
