Elevator Maintenance Company, Casino Facing Damages Claim in Slip and Fall

Wednesday, July 24, 2013

A woman who suffered serious injuries in a slip and fall accident in an elevator at an Atlantic City casino resort has filed a lawsuit against the casino as well as the elevator maintenance company.

The woman says that she was in an elevator at the Atlantic City Hilton, when the elevator dropped slightly, and this caused her to catch her foot on the edge of the floor. As a result, she fell inside the elevator, and suffered head and back injuries.

According to the lawsuit, as a result of the injuries, the woman suffered a concussion, a mild traumatic brain injury, and cerebral blood clot. As a result of those injuries, she continues to suffer from post-concussion syndrome, lightheadedness, frequent headaches, fatigue, ringing in the years, loss of sleep, memory loss as well as several musculoskeletal injuries.

The lawsuit also claims that as a result of the injuries, she suffered mental anguish, embarrassment and humiliation. The lawsuit alleges heavy substantial medical expenses as a result of the injuries.

According to the lawsuit, the casino as well as the company that was hired to maintain the elevator was aware of a leveling problem with the device before her accident. However, these problems were not properly addressed, and the lawsuit alleges that the casino as well as elevator company did not make timely repairs of the problem with the elevator.

The company also failed to remove the elevator from service when it found out that the elevator had a leveling defect that could increase the risk of an accident. The casino and the elevator maintenance company are also accused of failing to warn patrons at the hotel about the dangerous conditions in the elevator.
