A woman, who suffered a fall at a Dollywood theme park in Tennessee, has filed a lawsuit against the operators and managers of the theme park.
The woman claims that she suffered a brain injury after she fell head first at the theme park. She claims in a lawsuit that the fall was the result of slippery conditions brought on by a mix of sleet and rain that made the ride very slick and slippery. She also claims in her lawsuit that there were no safety measures on the ride, which would have blocked the fall.
Dollywood is a theme park that is owned, operated and managed by country entertainer Dolly Parton. The claim names Dolly Parton Productions Inc. and Herschend Family Entertainment Corp. as defendants.
According to the claim, the accident occurred in December 2013, when the woman was on vacation with her family at the theme park. While on the ride, the woman fell headfirst from the ride, and suffered a severe brain injury. As a result of the brain injury, she has been left with permanent impairments.
The woman claims in her lawsuit that one of the park employees assured her that the ride was safe to be on. Conditions were wintry at the time of the accident, but the employee told her that it was safe to go on the ride. This is a revolving ride that has individual seats that can go up approximately 25 feet into the air, and tilt outward. The lawsuit claims that the chairs did not have locking mechanisms that would restrain occupants in their seats. She also claims that employees at the park did not warn her about not getting out of the seat, or opening the lap bar before the ride was fully on level ground. The lawsuit is claiming $450,000 in damages along with other costs.
